Marketplace Facilitators Explained: Does Amazon (or Shopify) Collect Tax For You?

The Short Answer

Amazon: yes. Amazon is a marketplace facilitator and collects sales tax on your behalf in all 45 US sales tax states.

Shopify: no. Shopify is a platform, not a marketplace. Your Shopify store sales are your direct sales — you collect, file, and remit.

Etsy: yes. Etsy is a marketplace facilitator.

eBay: yes. eBay is a marketplace facilitator.

TikTok Shop: yes. Marketplace facilitator.

Your own website: no. Your direct sales are always your responsibility.

What Is a Marketplace Facilitator?

A marketplace facilitator is a business that:

  1. Operates a marketplace where third-party sellers list goods
  2. Facilitates the transaction (processes payment, handles checkout)
  3. Is required by law to collect and remit sales tax on those transactions

Every state with a sales tax has enacted marketplace facilitator laws — most between 2018 and 2021. These laws shifted the sales tax collection burden from individual sellers to the large platforms that process millions of transactions.

The practical result: if you sell through Amazon, Etsy, eBay, Walmart, or most other major marketplaces, the platform handles sales tax collection and remittance. You don't need to do anything for those sales.

The Nuances That Trip Sellers Up

Nuance 1: Your Direct Sales Are Still Your Problem

Marketplace facilitator laws only cover sales made through the marketplace. If you also have a Shopify store, your own website, or sell directly on social media, those sales are your responsibility regardless of what Amazon does for you on Amazon.

Many sellers make the mistake of thinking "I use Amazon and they handle my taxes" — not realizing their Shopify store has a completely separate and un-handled tax obligation.

Nuance 2: Marketplace Sales May Still Count Toward Your Threshold

In most states, marketplace-facilitated sales are excluded from your own economic nexus threshold. But not all states:

States that count marketplace sales toward YOUR threshold:

  • California
  • Michigan
  • North Carolina (since July 2024)
  • Washington

In these states, even though Amazon collects the tax on Amazon sales, those sales count when calculating whether you've crossed the $100,000/$500,000 threshold for direct sales in that state.

Example: You sell $600,000 through Amazon into California and $100,000 through your Shopify store. California's threshold is $500,000 total. Your combined California total is $700,000 — you have California nexus for your Shopify store even though Amazon handled the Amazon portion.

Nuance 3: Washington's B&O Tax Applies Regardless

Washington has a Business & Occupation tax on gross receipts — separate from sales tax. Even when a marketplace facilitator handles your Washington sales tax, you as the seller may still owe Washington B&O tax on the revenue from those sales. This is the most commonly missed compliance obligation for marketplace sellers.

Nuance 4: Not All Marketplaces Are Equal

A marketplace facilitator must both facilitate the transaction AND process the payment. If a platform only lists your products but doesn't process payment, it may not qualify as a marketplace facilitator. Verify your specific platform's status — most major platforms are registered facilitators, but niche platforms may not be.

Nuance 5: If the MF Doesn't Have Nexus, You Do

In some states (Michigan is the clearest example), if the marketplace facilitator doesn't have nexus in that state, the collection obligation falls back to you as the seller. Taxero monitors MF nexus status so you're not caught off-guard.

What About Shopify Payments?

Shopify Payments processes your transactions, but that doesn't make Shopify a marketplace facilitator for your sales. Shopify Payments is a payment processor — your Shopify store is your direct channel, and you're the retailer of record.

If Shopify itself has a marketplace (where sellers list on a shared storefront accessible to buyers), that's different. But standard Shopify stores are direct channels owned by you.

Practical Implications for Multi-Channel Sellers

If you sell on Amazon + Shopify (a very common setup):

  1. Amazon handles all tax collection on Amazon sales
  2. Your Shopify sales are your responsibility — you must register, collect, file, and remit
  3. In CA, NC, MI, WA: your Amazon volume counts toward your Shopify nexus threshold
  4. In WA: you may owe B&O tax even when Amazon handles sales tax
