Sales Tax Nexus in Alabama: What Online Sellers Need to Know
The Short Answer
Alabama's economic nexus threshold is $250,000 — one of only two states with a threshold higher than $100,000. Alabama also offers remote sellers a compelling shortcut: the Simplified Sellers Use Tax (SSUT) program, which replaces all state and local sales taxes with a single flat 8% rate. For most Shopify and online sellers, SSUT is the way to go.
Economic Nexus Threshold
- Dollar threshold: $250,000 in retail sales into Alabama (current or prior calendar year)
- Transaction threshold: None
- Effective date: October 1, 2018 (Act 2018-539)
Alabama's $250,000 threshold means many smaller online sellers won't have an Alabama obligation at all. If you're doing $150,000 in Alabama sales, you're below the threshold.
Does Alabama Count Marketplace Sales Toward Your Threshold?
If you sell exclusively through marketplace facilitators (Amazon, Etsy, etc.) that certify they're collecting and remitting Alabama tax on your behalf, you're generally relieved of the registration requirement regardless of your sales volume. If you have both marketplace and direct sales, your combined total counts.
What Taxable Products Look Like in Alabama
Alabama's standard system has a 4% state rate plus highly variable local rates (over 400 taxing jurisdictions, some exceeding 10% combined). However, most remote sellers should use SSUT:
SSUT (Simplified Sellers Use Tax) — Flat 8% rate:
- Replaces ALL state and local taxes with a single 8% flat rate
- You only file one return with the state DOR — no local registrations
- You're shielded from local audits — only the state DOR can audit you
- You must have no Alabama physical presence to qualify
For online sellers without Alabama warehouses, SSUT is almost always the right choice.
- Groceries: Alabama reduced the state grocery rate to 3% (September 2023). Under SSUT, groceries are taxed at 8% (the flat SSUT rate doesn't distinguish product categories).
- Clothing: Taxable under both standard and SSUT tracks
- SaaS: Uncertain under Alabama's standard rules. Under SSUT, all sales are at the flat 8% rate.
How to Register in Alabama
- Portal: myalabamataxes.alabama.gov (My Alabama Taxes — MAT)
- Register for: SSUT (if no Alabama physical presence)
- Cost: Free
- Timeline: Same-day to 2–3 business days
Filing Requirements
SSUT filers file monthly via MAT by the 20th of the following month. Single return, flat 8% rate — one of the simplest compliance routines in the country once you're registered.
What Happens If You Don't Register
Alabama's penalty structure includes a 10% penalty or $50 minimum, plus interest. The state DOR has authority to assess estimated tax if you fail to file.
How Taxero Handles Alabama
Taxero registers eligible sellers under SSUT — the flat 8% program that eliminates local complexity. We track your sales toward the $250,000 threshold (not the standard $100K), handle SSUT registration, and manage your monthly MAT filings. If you later establish Alabama physical presence, we'll alert you to transition from SSUT to the standard track.
