Sales Tax Nexus in Massachusetts: What Online Sellers Need to Know

The Short Answer

Massachusetts triggers sales tax obligations at $100,000 in total sales — no transaction count required. One rate, everywhere in the state, no local additions. Marketplace-facilitated sales don't count toward your threshold. One catch: Massachusetts taxes SaaS, and has been doing so longer than most states.

After you cross the threshold mid-year, collection begins on the first day of the month two months after you hit it. (Cross in August → collect starting October 1.) This timing rule is different from most states, which often require immediate or next-month collection.

Does Massachusetts Count Marketplace Sales Toward Your Threshold?

No. Marketplace-facilitated sales through Amazon, Etsy, and other platforms are excluded from your own $100,000 threshold calculation. Only your direct sales count.

The marketplace facilitator has its own Massachusetts obligation — they collect and remit once their combined facilitated sales reach $100,000. But that doesn't affect your personal threshold calculation.

What Taxable Products Look Like in Massachusetts

Massachusetts: one rate, statewide, no exceptions for location. No district taxes, no county additions, no city taxes anywhere in Massachusetts.

  • Clothing: Items costing $175 or less per item are exempt. The portion above $175 on a higher-priced item is taxable. (Different from New York's $110 threshold and Pennsylvania's unlimited exemption.)
  • Groceries/Food: Most food for home consumption is exempt. Prepared food and meals are taxable.
  • SaaS and digital goods: Massachusetts taxes SaaS and remotely accessed software. Massachusetts was an early adopter of cloud software taxability — if you sell software subscriptions or SaaS products, they're taxable in Massachusetts.

How to Register in Massachusetts

Massachusetts is not an SST member. Register via MassTaxConnect:

  • Timeline: A few business days
  • Form: ST-9 (Sales and Use Tax Return)

Filing Requirements

Massachusetts assigns filing frequency based on your annual liability:

  • Monthly: Annual liability over roughly $1,200/year
  • Quarterly: Smaller sellers
  • Annual: Very small filers

Due date: 20th of the month following the reporting period. File electronically via MassTaxConnect.

What Happens If You Don't Register

Massachusetts penalty structure:

  • Late payment: 1% per month on unpaid tax
  • Negligence penalty: 5% of underpayment
  • Failure to file: $100 per month minimum

Massachusetts DOR has a voluntary disclosure program. Past-period exposure can typically be resolved with a limited lookback period.
