Sales Tax Nexus in Ohio: What Online Sellers Need to Know
The Short Answer
Ohio triggers a sales tax obligation once you hit either $100,000 in sales or 200 transactions — whichever comes first. Ohio is a full member of the Streamlined Sales Tax (SST) project, which simplifies registration. Marketplace sales count toward your Ohio threshold. SaaS is generally not taxable in Ohio.

Ohio uses an "either/or" structure — unlike New York, which requires both. If you make 300 small Ohio transactions totaling $60,000, you've crossed Ohio's threshold.
Does Ohio Count Marketplace Sales Toward Your Threshold?
Yes. Ohio aggregates all channels — your direct sales plus marketplace-facilitated sales through Amazon, Etsy, and other platforms. A marketplace seller should combine all Ohio transactions (through all platforms and their own direct channels) when determining whether they've crossed either threshold.
Once registered, the marketplace collects and remits tax on its facilitated sales; you're not double-taxed. But those sales count for threshold purposes.
What Taxable Products Look Like in Ohio
Ohio's state rate carries county permissive taxes that vary by county, including in Cuyahoga County (Cleveland) — check the Ohio Department of Taxation's rate lookup for your buyer's exact combined rate.
- Clothing: Taxable — Ohio has no clothing exemption
- Groceries/Food: Most food and food ingredients for home consumption are exempt. Prepared food, restaurant food, and soft drinks are taxable.
- SaaS and digital goods: Ohio generally does not tax SaaS — Ohio has not enacted broad digital goods/cloud software legislation. Prewritten software on physical media or as a download is taxable, but pure SaaS (no software transfer) is typically not.
How to Register in Ohio
Ohio is an SST member — you have two registration options:
- SST SSTRS: sstregister.org — simplest path for remote sellers
- Ohio Business Gateway: gateway.ohio.gov
- Cost: Free
- Timeline: A few business days
Ohio's SST membership means registration via SSTRS is seamless and covers Ohio along with any other SST states you register for simultaneously.
Filing Requirements
Ohio assigns filing frequency based on annual liability:
- Monthly: Annual liability over $1,200/year
- Quarterly: Annual liability $300–$1,200
- Annual: Under $300/year
Due date: 23rd of the month following the period. File Form UST-1 electronically via Ohio Business Gateway.
Ohio's SST membership also means eligible sellers can use certified service providers (CSPs) for automated filing.
What Happens If You Don't Register
Ohio's penalty structure:
- Late payment penalty: 10%
- Failure to file: 10%–50% depending on circumstances
- Interest: Federal short-term rate + 3%
Ohio has a sales tax Voluntary Disclosure Agreement program. Past-period exposure can often be resolved with a limited lookback and reduced penalties.
