eBay is a marketplace facilitator in all 46 U.S. sales tax jurisdictions. That means eBay collects and remits sales tax on most transactions automatically — but it does not eliminate your nexus obligations. If your eBay sales cross the economic nexus threshold in a state ($100K or 200 transactions in most states), you still need to register in that state, even if eBay is collecting the tax.
Some eBay categories and seller types are exempt from marketplace facilitator rules — notably Business & Industrial and some vehicle parts transactions. Your gross eBay sales count toward nexus thresholds even when eBay remits the tax.
