Square Sales Tax Guide for Sellers in 2026

Does Square Collect Sales Tax For You?

Partially. Square helps you calculate and collect sales tax at the point of sale — but it doesn't file returns or remit collected tax to state agencies. That's your responsibility.

Square is a payment processor and POS system. Square Payments is not a marketplace facilitator in the way Amazon or Etsy is. Your sales are your sales — Square just processes the payment and can calculate the appropriate rate.

For online Square sellers who use Square's e-commerce features: same rules apply. Square calculates rates; you register, file, and remit.

What You Still Owe Even If Square Calculates It

  1. Registration: You must register in every state where you have nexus before you start collecting
  2. Filing: Monthly, quarterly, or annual returns in each registered state
  3. Remittance: Sending collected tax to each state on time

Square holds collected tax in your account until you remit it. Square does not remit on your behalf.

Your Nexus Exposure on Square

Square is most commonly used by:

  • Brick-and-mortar retailers with physical presence — these sellers have immediate physical nexus in their state from day one
  • Pop-up and market sellers — physical presence at events in other states may create temporary nexus
  • Multi-location businesses — each state where you have a location creates physical nexus in that state
  • Restaurants and food service — multiple Square terminals across locations create multi-state nexus

For multi-location Square merchants who've expanded into multiple states, each new state location creates immediate physical nexus — no economic threshold required.

Square + online sales: Many Square users also sell online (via Square Online or separately). Online sales aggregate with POS sales for economic nexus threshold purposes.

Step-by-Step: Getting Compliant as a Square Seller

  1. Identify your physical presence states — every state where you have a location, employee, or regular market presence
  2. Register in each physical presence state (immediate requirement — no threshold)
  3. Check online sales thresholds for states where you sell remotely but don't have physical presence
  4. Configure Square to collect at the right rates in each registered state
  5. Set up regular filing and remittance — Taxero handles this

How Taxero Works With Square

Taxero integrates with Square via CSV export or API connection. We pull your Square POS and online sales data to:

  • Map your physical presence states (POS location data)
  • Track your economic nexus thresholds for online sales
  • Handle multi-state registration
  • Calculate tax by location and period
  • File returns and remit to each state

Taxero is one of the few compliance services with dedicated Square support — important for POS merchants who need multi-state, multi-location handling.

Common Questions

I have Square in two states. What do I need? Register in both states. Each physical location creates immediate nexus. Square will need to be configured to collect at the correct rates for each state.

I use Square at farmers markets in neighboring states a few times a year. Do I have nexus there? Potentially. Regular attendance at markets or events in another state can create nexus. "Casual" or infrequent presence is often not nexus-creating, but the line varies by state. Taxero can assess your specific situation.

I use DAVO for sales tax. Should I switch? DAVO is single-state only — if you have locations or sales in multiple states, you've outgrown what DAVO can handle. Taxero is multi-state, multi-channel, built for merchants exactly like you.
